CookTop Safety Corporation (“CookTop Safety,” “CTS,” “we,” “us,” or “our”) values your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our smart kitchen sensors, dashboard software, mobile applications, and related services (the “Services”).

By using the Services, you consent to the practices described in this Privacy Policy.

Information We Collect

We collect the following categories of information:

a. Sensor Data

• Cooking activity, heat and thermal patterns, motion detection, and safety-related events.

• Device performance data (sensor health, firmware version, connectivity status).

b. User Account Data

• Name, email, phone number, and role (e.g., caregiver, property manager, resident).

• Login credentials and security preferences (processed via Auth0).

c. Usage Data

• Dashboard and app activity, alert settings, notification preferences.

• Interactions with features and integrations.

d. Technical Data

• IP address, device identifiers, operating system, and browser type.

• Log files, diagnostic reports, and crash/error data.How We Use Information

We use information to:

• Provide real-time alerts, insights, and analytics.

• Improve the accuracy of sensor detection and AI models.

• Support caregivers, residents, and property managers with safety monitoring.

• Provide customer support and troubleshooting.

• Conduct research and product development using de-identified or aggregated data.

• Comply with legal and regulatory obligations.

Sharing of Information

We do not sell personal data. We may share information with:

• Service Providers such as AWS (cloud hosting), Auth0 (identity and authentication), and analytics providers.

• Authorized Caregivers/Property Managers linked to your account.

• Regulatory Authorities if required by law.

• Business Transfers in the event of a merger, acquisition, or sale.

Data Retention

• Sensor event data: retained for up to 24 months.

• Account data: retained while your account remains active.

• Aggregated/anonymized data: may be retained indefinitely.

You may request deletion of your data at any time (see “Your Rights”).

Security

We use industry-standard safeguards, including encryption, access controls, and security monitoring. While we take reasonable steps to protect your information, no method of storage or transmission is 100% secure.

Children’s Privacy

The Services are not directed to children under 13 (or under 16 where applicable). We do not knowingly collect data from children without verified parental consent.

Your Rights Depending on your jurisdiction (e.g., GDPR, CCPA), you may have rights to:

• Access, correct, or delete your personal data.

• Request data portability.

• Opt out of certain uses of your data.

2. Terms of Service & User Agreement

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of CookTop Safety’s smart kitchen sensors, dashboard software, apps, and related services (the “Services”). By using the Services, you agree to these Terms.

2. Eligibility

• You must be at least 18 years old to use the Services.

• Caregivers, property managers, or organizations represent that they have authority to use the Services on behalf of those they support.3. Services Provided

CTS provides:

• Smart Kitchen Sensors to monitor cooking activity and detect risks.

• A dashboard and mobile apps that deliver real-time alerts, notifications, and analytics.

• Integrations with third-party smart home or property management systems.

4. User Responsibilities

• Use the Services only for lawful purposes.

• Maintain the confidentiality of your account credentials.

• Do not tamper with, reverse engineer, or misuse the Services.

5. Data & Privacy

Our Privacy Policy governs how we collect, use, and protect your data. By using the Services, you agree to our Privacy Policy.

6. Alerts & Notifications

The Services provide safety insights and alerts, but:

• They do not guarantee prevention of accidents, fires, or hazards.

• Alerts depend on internet connectivity and may be delayed or interrupted.

• The Services are supportive tools only and are not substitutes for emergency response or fire suppression systems.

7. Software & Updates

We may release updates, patches, or enhancements. Continued use of the Services constitutes agreement to receive updates.

8. Subscription & Fees

Some features may require a subscription. Pricing, payment terms, and cancellation rights will be disclosed at purchase.

9. Intellectual Property

All software, firmware, trademarks, and content remain the property of CTS. You are granted a limited, non-exclusive, non-transferable license to use the Services.

10. Limitation of Liability

CTS is not liable for:

• Damages caused by device misuse, connectivity loss, or user negligence.

• Any indirect, incidental, or consequential damages.

Our maximum liability is limited to the amount paid by you for the Services in the past 12 months.

11. Termination

• You may terminate your account at any time.

• CTS may suspend or terminate accounts that violate these Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, U.S.A.

3. Consent Notice (Dashboard/App)

Before continuing, please review and accept our Terms and Privacy Policy. By creating an account or using the CookTop Safety dashboard and smart sensor system, you agree that:

• CTS may collect and process cooking, device, and usage data to provide real-time alerts, analytics, and system improvements.

• Your data may be shared with authorized caregivers, property managers, or service providers as described in our Privacy Policy.

• CTS does not sell personal data and uses safeguards to protect your information.

• The Services are supportive tools only and do not replace emergency response systems.

☑ I have read and agree to the Terms of Service and Privacy Policy.4. Data Processing Agreement (DPA) This DPA applies where CookTop Safety (“Processor”) processes personal data on behalf of the Customer (“Controller”).

1. Roles

• The Customer is the Controller.

• CTS is the Processor.

• Sub-processors (e.g., AWS, Auth0, analytics providers) may be used, subject to equivalent obligations.

2. Processing Purposes

CTS processes data to:

• Deliver alerts, analytics, and monitoring.

• Provide technical support.

• Maintain and improve system performance.

• Comply with legal obligations.

3. Security Measures

CTS implements:

• Encryption in transit and at rest.

• Authentication and access controls.

• Security monitoring and incident response.

4. Data Subject Rights

CTS will assist Customers in fulfilling data rights requests (access, correction, deletion, portability, restriction).

5. Breach Notification

CTS will notify the Customer without undue delay if a data breach occurs.

6. Data TransfersData may be processed in the U.S., Canada, or other jurisdictions where CTS or its sub-processors operate. Safeguards will be applied as required by law.

7. Retention & Deletion

Upon termination, CTS will delete or return personal data unless retention is legally required. Aggregated data may be retained.

8. Audits

Customers may request audit rights once per year or following a security incident.

9. Liability & Law

Liability is subject to the Terms of Service. This DPA  is governed by the laws of the Commonwealth of Massachusetts, U.S.A.
